Article I. Introductory Provisions and Definitions

  1. These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the rights and obligations between the operator of the e-shop, the reservation system, and the distribution service provider (hereinafter referred to as the “Seller”):

    • The seller is an individual conducting business who is not registered in the Commercial Register. The seller is not a VAT payer.

  2. The term “buyer” refers to an end customer (consumer or business) who uses the atelierp7.cz website to sign up for courses or workshops, or to purchase gift certificates and reservation vouchers.

  3. Technical Support and Studio Operations: The Buyer acknowledges that the physical and technical organization of the courses, the supply of materials (clay, glazes), expert instructor supervision, the firing process in kilns, and the operation of the physical studio space at Dukelských hrdinů 909/50, Prague 7, are provided by audit.digital s.r.o. (Company ID: 09058257, registered office: Dukelských hrdinů 909/50, 170 00 Prague 7, VAT payer) pursuant to a commercial contract. This company also serves as the direct organizer and contracting party for individually arranged corporate team-building events, studio rentals, and group events for corporate clients.

Article II. Order, Conclusion of the Contract, and Payment Terms

  1. The presentation of courses and vouchers on the website is for informational purposes only. The buyer orders services by filling out the electronic order form on the website.

  2. Condition for Payment to Be Credited: The purchase agreement is not considered properly concluded, and a binding reservation for a spot in the course (or the issuance of a voucher) is not considered valid, until the full amount due has been credited to the bank account. Until then, a spot in the course is not guaranteed.

  3. Breakdown of payment flows:

    • Payments for standard public courses, workshops, and gift certificates (B2C) are transferred to the Seller’s bank account (Ladislav Šuster, not a VAT payer).

    • Payments for corporate team-building events and individual corporate events (B2B) are transferred directly to the studio operator’s bank account (audit.digital s.r.o., a VAT payer) based on an advance/tax invoice issued.

Article III. Gift Certificates and Reservation Vouchers

  1. Validity of Vouchers: Gift and reservation vouchers are valid for 1 year (12 months) from the date of issue. The purchaser is required to redeem the voucher and complete the course within this period.

  2. Vouchers are non-refundable —once purchased, they cannot be refunded or exchanged for cash.

  3. Vouchers are fully transferable. The purchaser or holder may transfer the voucher to another person, but is required to notify the studio in advance of this change and provide the name of the new participant.

  4. Good Faith Policy (Expiration): After one year, the gift certificate formally expires. However, as part of our client-oriented approach and in the spirit of good faith, the studio may accept older gift certificates upon prior agreement; however, there is no legal entitlement to such an extension. If course prices have increased since the voucher was purchased, the voucher holder is required to pay the difference to the current price in effect on the day the new date is reserved when redeeming the voucher after its expiration date.

Article IV. Cancellation Policy and Schedule Changes

  1. If a customer is unable to attend a class on the reserved date, they must cancel or request a rescheduling no later than 24 hours before the class begins.

  2. The buyer acknowledges that last-minute cancellations (or failure to show up without an excuse) cause a scheduling problem, as the reserved spot and the instructor’s time remain unused.

  3. A Human Approach: As a general rule, cancellations made less than 24 hours in advance result in forfeiture of the lesson. However, the studio strives to handle situations with compassion—in individual cases and with timely communication, it will try to accommodate students and offer an alternative time slot, provided the studio’s capacity allows it.

Article V. Withdrawal from the Contract (14-Day Consumer Withdrawal Period)

  1. In accordance with Section 1829 of the Civil Code, the Buyer (if purchasing online as a consumer) has the right to withdraw from the purchase agreement within 14 days of purchasing the gift certificate without providing a reason.

  2. Notice of withdrawal from the contract must be sent in writing to the following email address: info@atelierp7.cz.

  3. The right of withdrawal expires if the voucher has already been redeemed within this 14-day period and the course has been completed in whole or in part (has physically taken place).

Article VI. Organizational and Operational Rules for the Program

  1. Lesson Length: Each standard lesson or workshop lasts approximately 2 hours.

  2. Arrival and Departure: Students are required to arrive at the designated time. For operational and preparatory reasons, it is not possible to arrive at the studio early or to stay for practice after the lesson has ended. Late arrival is permitted (the participant will join the lesson once it has begun), but the time lost due to the delay will not be made up.

  3. Apartment Building Rules (STRICTLY PROHIBITED): The studio is located inside a residential building. The studio does not have its own doorbell. It is strictly prohibited to ring the doorbells of residents or apartments. Upon arrival, please wait for the instructor, contact him or her by phone, or gently knock on the studio window. Unaccompanied individuals are not permitted to move freely throughout the building.

  4. No Accompaniment or Guests: For safety and space reasons, participants may not be accompanied by anyone (friends, partners, or children as spectators). Due to the nature of the building, guests are also not permitted to wait in the building’s interior hallways.

  5. No Pets Allowed: Pets (dogs, cats, etc.) are not permitted in the studio; the materials and sharp tools there may be dangerous to them.

Article VII. Health, Safety, and Attire

  1. Health: You are not permitted to attend classes if you have an acute or infectious illness.

  2. Contraindications: Work in the studio involves clay and specific types of dust. The courses may not be suitable for people with severe asthma, those with allergies to dust or glaze ingredients, or those with serious physical or cognitive limitations that prevent them from safely handling tools. Pregnant women and parents of young children should consult with the instructor regarding their participation, given the handling of chemical components in glazes.

  3. Clothing and Equipment: Participants are required to wear closed-toe shoes (for foot protection), and comfortable clothing that can get dirty is recommended. The studio provides basic materials and tools. Participants are responsible for providing their own specific personal protective equipment (e.g., their own face mask/respirator or goggles for advanced glazing).

Article VIII. Specifics of Ceramic Production and Complaints

  1. Technological Risk of the Material: Ceramics is a living medium that reacts to extreme heat, moisture, and tension. The Buyer acknowledges that even with the utmost care of the instructor and the student, the product may crack, deform, or completely break during the drying or firing process. The studio does not provide any financial compensation, discount, or tuition refund for products damaged during the drying and firing processes. The costs for preparation, energy, materials, and course facilitation arise independently of how the clay behaves in the kiln.
  2. Standard Pickup Period: The drying and double firing process takes several weeks. Finished products are standardly ready for pickup 3 to 4 weeks after the end of the course. The Buyer is obliged to pick up their products no later than 4 weeks from the moment they are informed that the items are ready for collection.
  3. Storage in an External Warehouse (from the 4th month): If the Buyer does not pick up their products within 4 months from the date of the course, these products will be moved to the Seller’s external warehouse due to capacity limitations.
    • A one-time fee of 800 CZK may be charged for handling and transport to the external warehouse.

    • A storage fee of 200 CZK per individual product may be charged for each started month the product is stored in the external warehouse.

  4. Liquidation or Sale of Products (from the 7th month): If the Buyer does not pick up their products even within 7 months from the date of the course, these items are considered abandoned. In such a case, the Seller is entitled to handle the products at their own discretion, in particular, to dispose of them ecologically or sell them to a third party to cover the incurred storage and handling costs.
    • Financial Settlement, Offsetting, and Non-Enforcement of Debts: In the event of a successful sale of an uncollected product to a third party, the proceeds from the sale belong to the Buyer (the owner). However, the Seller is entitled to unilaterally offset their claim for the outstanding storage and transport fees against the Buyer’s claim for the release of the sales proceeds. Given that the total logistical costs of the studio generally exceed the real market value of the product, the Buyer acknowledges that any such sale is realized at an economic loss and they have no right to the payment of any remaining balance.

    • Explicit Reassurance for Customers: The Seller explicitly declares that the above fees serve exclusively as an accounting and legal mechanism to settle costs in the event of the sale of an abandoned item. The Seller will never actively or legally enforce these amounts (storage fees, transfer fees) from the Buyer if the Buyer simply decides not to pick up their product and leaves it to the studio for disposal.

    • Studio’s Goodwill: Handing over products from the external warehouse is possible only by prior arrangement. Although the studio incurs demonstrable costs with the transfer, as part of a pro-client approach and goodwill, the Seller reserves the right to fully or partially waive these fees for the Buyer if the product is still physically available for collection.

  5. External Firing: For safety reasons and due to the risk of damaging the kiln, the studio does not provide kiln rentals or firing services for unknown pieces made outside the studio premises.

Article IX. Final Provisions

  1. These General Terms and Conditions are valid and effective as of July 1, 2026, and supersede all prior oral and written agreements.

  2. Any matters not covered by these General Terms and Conditions shall be governed by the applicable laws of the Czech Republic, in particular the Civil Code and the Consumer Protection Act.

  3. By submitting an order, the buyer confirms that they have read these Terms and Conditions, understand them, and agree to them in their entirety.
